1. PROTECTION OF YOUR PERSONAL INFORMATION – OUR DUTY
We are fully aware of the sensitive nature of your personal information and the consequences of such information falling into the wrong hands and accordingly, we take serious and reasonable measures to safeguard such information from access by unauthorised parties.
By clicking proceed, you agree, guarantee and warrant that:
- As a client of Global Firearm Motivations – you expressly consent to us:
- receiving, processing and safeguarding your personal information and / or the personal information of your employees etc. in as far as it is necessary and relevant to the formulation and drafting of firearm licence motivations for the purposes of your submission thereof to the Central Firearms Registry;
- processing any Special Information as envisaged at section 26 of the Protection of Personal Information Act 4 of 2013 [as per s27(1)(a)]; and
to the storage of your Personal Information for the duration of 3 years after fulfilment / completion of the mandate / instructions whereafter all electronic copies of documentation in our possession relating to your Personal Information must be destroyed / deleted in a permanent fashion, alternatively, de-identified of any unique identifiers pertaining to you.
1.1 You confirm and agree that you are aware that we have a POPI Act Compliance Framework document which is available for inspection upon request as well as a PAI Act Manual which is also available for inspection upon request directed to www.gfmlicenseme.co.za.
1.2 You further agree that you will contact us for any queries arising from or relevant to access to information or protection of personal information.
2. GENERAL TERMS AND CONDITIONS
Acceptance of Terms
You will only be able to use this service after agreeing to the POPI Act terms and conditions and consent as well as through the acceptance of our General Terms and Conditions hereunder.
Application Information
Applicant is to fill in / set out all information required relating to the Applicant’s application (s13, s15 or s16 relevant information) – incomplete information forms will be sent back to be filled in properly (do it once – do it right) – the accuracy of all information provided to us is the responsibility of the Applicant.
Commencement of Work
Work on the motivation will commence upon:
1. Payment reflecting;
2. the prescribed necessary personal information being supplied to us in the correct format in the required detail; and
3. your express consent for the processing of your personal information by us for the purpose of formulating and drafting your motivation;
Delivery Timeframe
From the date of payment reflecting in our bank account – we will, within 7 business days, deliver the motivation per e-mail to your nominated e-mail address in locked PDF format.
Refund Policy
Should we be unable to deliver the motivation to you within 7 business days – you will inform us per e-mail to admin@gfmlicenseme.co.za and should we, within 3 further business days, not be able to furnish you with your motivation – you will be entitled to a full refund to be arranged through admin@gfmlicenseme.co.za (NOTE: this is the only time that refunds will be processed and we will not process refunds under any other circumstances whatsoever).
Intellectual Property
All motivations, their style, content and format are the intellectual property of Global Firearm Motivations Pty Ltd.
No Unauthorized Distribution
You agree to refrain from circulating or sharing our motivations to third parties and should it come to our attention that you are circulating motivations prepared by us; you agrees that we will be entitled to pursue you for such unauthorised distribution and for damages and / or loss flowing from such unauthorised distribution.
Format Restrictions
You further agree to refrain from converting the PDF format motivation delivered to you by us into any manipulable text format / Word format for manipulation and re-use for any purpsoe whatsoever and this will also give rise to grounds for a damages claim against you (considering that the distributor or unathorised editing party may bring the style and name of our reputable brand into disrepute through motivation manipulation and submission to the Central Firearms Registry);
Fraud Prevention
Fraudulent proof of payments will be reported to the South African Police Service and pursued to the fullest extent.
Paperless Service
We offer a paperless service and our services are provided by way of correspondence (e-mail) for client convenience– all communication between you and our team will be per e-mail for record-keeping purposes.
Correction Policy
Considering that we offer our services by way of correspondence – you acknowledge that there may be some inaccuracies, errors or misnomers regarding details on the first draft that you receive from us and that we will, free of charge, remedy such mistakes or errors within 48 hours of notification per e-mail from you to admin@gfmlicenseme.co.za (provided that you furnished us with the correct information in the information sheet).
Client Conduct
We will not tolerate abusive clients and / nor impatient clients and will not entertain daily follow-ups by clients in respect of the progress of their motivations.
No Follow-Ups
WE ARE NOT A CALL CENTRE AND WE ARE NOT A FOLLOW-UP SERVICE PROVIDER. THE APPLICANT WILL BE RESPONSIBLE FOR ALL FOLLOW-UPS WITH THE CENTRAL FIREARMS REGISTRY (FOR LICENCE APPLICATIONS) REGARDING THE PROGRESS OF THE APPLICATION.
No Expedited Processing
THERE IS NO SUCH THING AS “CONTACTS” AT THE CENTRAL FIREARMS REGISTRY AND WE DO NOT OFFER OR UNDERTAKE TO “EXPEDITE” APPLICATION PROCEEDINGS.
Correction of Errors
In the case of your motivation being refused due to any fault by our drafting team (not in the case of fault by CFR or the client or any failure by the client to follow our guidelines set out in our instructions that accompany each application) – attend to the appeal free of charge to remedy such fault through a trusted legal service provider (mistakes / fault by our drafting team will include making errors in law or blatant errors in respect of firearm applications and purposes – as well as ill-advising clients on the category / section of licencing to be applied for; provided that clients furnish us with all relevant and critical information requested by us).
Exclusions for Refusals
We do not accept responsibility for arbitrary refusal reasons such as the usual “Insufficient motivation : You failed to convince the Registrar that there is a need for this particular firearm” and “You have failed to convince the Registrar why the firearm in your current possession does not satisfy this need” as that is not a legitimate refusal reason for hunting / sport shooting under section 15 or section 16. The reason for this is due to “need” only being referred to in Section 13 of the Act for licences to possess firearm for self-defence. This exclusion extends to all refusal reasons which are based on incorrect applications of the legislation to the applicant’s facts or incorrect interpretations of legislation by the CFR.
Self-Defense Applications
In respect of s13 applications (licences for self-defence) – the Registrar determines whether the applicant has a “need” – as it is entitled to do so in terms of the Act. We go the extra mile in motivating self-defence applications using the subjective circumstances of each applicant. It must also be shown that alternative measures have been considered and must deal with why they are inadequate. We cannot accept responsibility for refusals on s13 applications where the Registrar refuses on the basis of “Insufficient need” or “Failed to explain why alternatives are not sufficient” as we expressly deal with each of these elements in great detail in our motivations.
Refusal Challenges
The usual arbitrary refusal reasons are dealt with our motivation to boost the applicant’s prospect of success.
Accreditation Compliance
We accept that your (if applicable) accredited association complies with s16(2) in respect of all relevant s16 documentation that you are provided with and will not accept responsibility for any refusal of applications relating to accreditation or legislative compliance by accredited hunting / sport shooting associations.
